ELIGIBILITY: NO PURCHASE NECESSARY TO ENTER OR WIN.
The Game 360.com Autographed T-Shirt Sweepstakes (the “Sweepstakes”) is open to legal residents of the United States (except Puerto Rico, Guam, U.S. Virgin Islands, and all other U.S. and foreign territories and possessions, and excluding where otherwise prohibited by law, rule or regulation), who are 18 years or older at the time of entry. Employees, officers, and directors (including immediate family members and members of the same household) of Czar Entertainment (“Sponsor”), MLB Advanced Media, L.P. (“MLBAM,”), the other MLB Entities and each of their affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate. The “MLB Entities” shall mean MLBAM, the Office of the Commissioner of Baseball, its Bureaus, Committees, Subcommittees and Councils, Major League Baseball Enterprises, Inc., Major League Baseball Properties, Inc. (doing business in its own name and as Major League Baseball Productions), SportsOnEarth, LLC, Tickets.com, Inc., the Major League Baseball Clubs, and each of their subsidiaries or affiliated entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Major League Baseball Clubs or the Office of the Commissioner of Baseball, and the directors, officers and employees of the above entities. The Sweepstakes is subject to all applicable federal, state, local laws and regulations. Void where prohibited or restricted by law.
HOW TO ENTER: The Sweepstakes begins at 12:00AM Eastern Time (“ET”) on February 5, 2007 and ends at 12:00AM ET on March 5, 2007 (“Entry Period”). There are two ways to enter: online, or by mail. No other method of entry will be accepted. Limit one entry per person regardless of method of entry.
1. Online Method: During the Entry Period go to www.THEGAME360.com and register for thegame360.com Email List. By submitting your complete name, date of birth, address, ZIP/postal code, telephone number and e-mail address via the online entry form, you will be automatically entered in the Sweepstakes. All information submitted by entrants is subject to TheGame360.com Privacy Policy accessible at: http://web.thegame360.com/about/privacy.jsp. Entrants must complete all non-optional data requested on the online entry form. Incomplete entries are void.
2. Mail-in Method: If you do not wish to enter online, you may enter the Sweepstakes by printing your name, address, city, state and zip code, day & evening telephone number and email address (optional) on a standard size postcard and mail to: Thegame360.com, 75 Ninth Avenue, Third Floor, New York, NY 10011 Attn: The Game 360.com Autographed T-Shirt Sweepstakes. Sponsor will only use email addresses provided via the Mail-in entry method for prize notification purposes only; however, eligibility to participate in the Sweepstakes is not dependent upon entrant’s provision of this information. Mail-in entries must be postmarked by March 5, 2007 and received by Sponsor by March 12, 2007. Mail-in entries become the property of the Sponsor and will not be returned.
DRAWING DEADLINES: There will be a total of five (5) weekly random drawings (one drawing on each Monday from February 12, 2007 through March 12, 2007 (the “Drawing Period”)) from among all eligible entries received. Weekly drawings will occur on or about each Monday at 5:00 PM ET of each week during the Drawing Period (February 12, February 19, February 26, March 5 and March 12) (each, a “Drawing Date”)). To be eligible for weekly drawings:
online entries must be received by 5:00 PM ET on the Sunday of the week prior to the week of the Drawing Date, and no later than by 12:00AM ET on March 5, 2007; or
mail-in entries must be post marked by no later than the Sunday of the week prior to the week of the Drawing Date and received by Sponsor no later than the Sunday of the week of the Drawing Date.
All non-winning weekly entries will be eligible for all subsequent drawings.
RANDOM DRAWING: There will be five (5) winners of the Sweepstakes (each, a “Winner” and collectively, the “Winners”) selected by random drawing on or about each Monday of each week during the Drawing Period from all eligible entries received by MLBAM. The decisions of Sponsor, including the selection of Winners, are final and binding on all matters relating to this Sweepstakes. Odds of winning depend on the total number of eligible entries received. All prizes will be awarded. Limit one prize per person, family or household.
PRIZES: FIVE (5) PRIZES WILL BE AWARDED. Each Winner will receive one (1) thegame360.com T-Shirt autographed by The Game (the “Prize”). (Estimated Retail Value of each Prize: $30). The Winners are fully responsible for any and all applicable federal, state, international and local taxes. All costs and expenses not specified herein, related to the Grand Prize, including but not limited to lodging, transportation costs, meals, taxes (including income taxes) and other expenses incurred by accepting the Grand Prize are the sole responsibility of the Winners. The Grand Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor’s sole discretion. There will be no substitutions for any prize except due to unavailability, in which case, a cash prize of equal value to the face value of the applicable prize will be awarded at the exclusive discretion of the Sponsor.
NOTIFICATION: The Winners will be notified by e-mail and/or telephone by the Sponsor and/or MLBAM, as applicable, and may (in Sponsor’s discretion) be confirmed by postal mail, return receipt (the "Prize Notification"). In the event that the Winners do not respond to such Prize Notification within three (3) days, a disqualification will result and an alternate winner shall be chosen from among all remaining eligible entries. The Winners will receive Sponsor’s Affidavit of Eligibility and Release of Liability, which must be completed, notarized and returned within five (5) days of receipt. A disqualification will result and an alternative winner will be randomly selected from among all remaining eligible entries if the Sponsor’s Affidavit of Eligibility and Release of Liability are not properly returned within the specified period of time. Refusal or return of Sponsor’s Affidavit of Eligibility and Release of Liability as non-deliverable will also result in disqualification and cause an alternative winner to be chosen from among all remaining eligible entries.
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, all entrants agree to be bound by these Official Rules, including all entry requirements. By entering the Sweepstakes, each Winner agrees to waive any and all claims against the MLB Entities and each of their respective agents and representatives (the “Released Parties”) for any injury, damage or loss that may occur from the participation in the Sweepstakes or from the receipt or use of any prize or travel related to the receipt or use of any prize. Participants agree to allow Sponsor, MLBAM and each of their designees to use their names and likenesses in any and all mediums now or hereafter known for advertising and publicity purposes throughout the world in perpetuity, without any compensation, notification or permission, unless prohibited by law.
GENERAL CONDITIONS: The Released Parties and each of their respective agents and representatives are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, late or misdirected entries, lost, damaged, garbled, delayed, misdirected, damaged, incomplete, postage due or illegible entries. Sweepstakes entries generated by a script, macro or other mechanical or automated means will be disqualified. The Released Parties and each of their respective agents and representatives are not responsible for incorrect, inaccurate transcription or loss or delay of entry or prize reply information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the Sweepstakes. If, in the Sponsor’s exclusive judgment, this promotion becomes compromised in any way, Sponsor’s reserve the right to withdraw the promotion offer, cancel any method of entry, to void any entries submitted fraudulently or select winners from all eligible entries received prior to act that compromised the promotion.
Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by the MLB Entities or their agents. Sponsor shall have the sole right to disqualify any contestant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in their sole discretion. The Released Parties (i) make no warranty, guaranty or representation of any kind concerning any prize, and (ii) disclaim any implied warranty. All disputes will be resolved under applicable U.S. laws in the County of New York, state of New York.
Sponsor reserves the right, in its sole discretion, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Released Parties corrupt administration, security, fairness, integrity or proper operation of the Sweepstakes. In the event of cancellation, Sponsor may elect to identify winners and award the Grand Prize by way of random drawing from among all entrants who had entered the Sweepstakes at the time of such cancellations.
All online entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the “Authorized Account Holder” of the e-mail address submitted at the time of the entry. The “Authorized Account Holder” is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail addresses for the domain associated with the submitted e-mail address.
WINNERS’ LIST: For a list of winners, mail a self-addressed stamped envelope to: TheGame360.com, Third Floor, 75 Ninth Avenue, New York, NY 10011, Attn: The Game 360.com Autographed T-Shirt Sweepstakes. Winner’s list requests must be made by June 1, 2007.
